AUTONOMOUS COMMUNITY PROSECUTOR (TSJ) of GRANADA Procedure: DILIG. CRIMINAL INVESTIGATION

Procedure No.: 0000056/2022 NIG: 1808773220220000937 2173009999E

REFERENCE AND ARCHIVE DECREE of the Ilmo. Mr. Prosecutor of the FCAA Mr. JESÚS GARCIA CALDERÓN, Granada, December 21, 2022

BACKGROUND

On October 4 and 7, 2022, this Prosecutor's Office received electronic communications, to which various documents are attached, from Graeme Walker, a British citizen residing in Portugal and owner of a property in the Costa Natura urbanisation, located in the province of Malaga, specifically in Estepona. The above states that in the community of owners of the aforementioned urbanisation there is a pattern of corruption and organised crime; referring to the fact that he has recently filed a complaint with the General Directorate for Competition of the European Commission, as well as made various reports to the Andalusian police. The complainant demands the initiation of an investigation in which he would provide, if necessary, his full collaboration.

Initiated the present Criminal Investigation Proceedings by virtue of Decree of October 4, 2022 of the Hon. Ms. Superior Prosecutor of Andalusia and designated this Prosecutor for processing, prior to the adoption of the proposal that may correspond, the Judicial Police Unit Attached to this Prosecutor's Office was notified so that, in view of the data that contain the numerous electronic communications received, issued a report on the facts.

Subsequently, on different dates, the complainant has reiterated his communications, both in Spanish and English, in analogous or similar terms to the previous ones, being linked to the proceedings under the respective Processing Decrees of October 11 and 21. November 2022; subsequently adding, by virtue of a last communication of November 30 of the same year, the request for help to promote its protection as a cultural asset of the Costa Natura urbanisation.

On November 21, 2022, the Judicial Police Unit attached to this Prosecutor's Office submitted the previously interested report, which has been attached to these proceedings. Lastly, it is important to remember that, in accordance with the criteria established in the current Circular 4/2013 of the State Attorney General's Office, the Decree of Initiation of this Attorney General's Office establishes the six-month investigation term established in article 5.2 of the Organic Statute of the Public Prosecutor's Office ( hereinafter, EOMF) and will conclude, unless an extension is agreed upon by the State Attorney General's Office, once six months have elapsed, on April 4, 2022.

FUNDAMENTALS

The police analysis of all the documentation received by the Public Prosecutor's Office reveals, with express reference to the content of its Report provided on November 21, the existence of a conflict in the framework of the management of the Community of owners of the urbanisation Costa Natura, where the complainant understands that there has been a continuous breach of the legislation on horizontal property and various irregularities in the management, pointing out who could be, in his opinion, the responsible persons. The Judicial Police considers, in the absence of verification procedures, the existence of a conflict in the economic management of the community of owners and in the destination given to treasury funds and income received from different farms. the community as hostelry and naturist activities. The Judicial Police understands that the exposition of the data that is carried out does not infer the existence of crimes typical of organised crime [...] although it does not rule out the possible existence of crimes in the framework of community management, once the pertinent procedures have been carried out.

In the case at hand, therefore, allusion is made to a situation that is beyond the objective and territorial jurisdiction of this Superior Prosecutor's Office. Having ruled out the existence of activities typical of organised crime that could require coordination, knowledge of the facts, as the police report also indicates, corresponds to the Provincial Prosecutor's Office of Malaga as the competent prosecutor's office that must, with full discretion, adopt the decision that legally corresponds.

Regarding the request for help to promote the protection of cultural legislation on the Costa Natura urbanisation, it is enough to point out that, in accordance with the provisions of Law 16/1985 on Spanish Historical Heritage and Law 14/2007 on Historical Heritage of Andalusia, this competence corresponds, in principle, to the Junta de Andalucía, without the ability of the Public Prosecutor to carry out legal advice in accordance with the provisions of article 57.6 of the EOMF.

In accordance with the background information and grounds briefly expressed, it is proposed that these Criminal Investigation Proceedings be forwarded to the Provincial Prosecutor of Malaga, notifying, in accordance with the provisions of articles 773 of the Criminal Procedure Law and 5 of the EOMF, this Decree of Remission and File to the complainant Graeme Walker.

Verified the previous transfer by the Prosecutor appointed in Criminal Investigation Proceedings number 56/2022, once the request that has been submitted to the Public Prosecutor's Office has been examined by the EXCMA. MR. SUPERIOR PROSECUTOR OF ANDALUSIA, agrees with the previous proposal.
